Although small cell deployments are in relatively early stages\, they have already began posing challenges for local governments\, whose experience in administering and regulating telecom is predominantly on macro [cell] towers.\n\n\n\nDesigned and built with different technical standards than macro [cell] towers\, small cell wireless networks have very different needs with respect to the use of local public rights-of-way. A landmark order of the Federal Communications Commission (FCC)\, helped create a regulatory framework for local governments but the complex nature of telecom continues to make things challenging for all parties involved in small cell deployments. This timely presentation and discussion on small cell networks and planning is specifically designed to address these critical challenges.\n\n\n\nThe first part of the presentation will provide an overview of network technology so that local governments can become familiar with the technology and its requirements and impacts.\n\n\n\nThe second part will provide an overview of state and federal regulatory framework relating to the use of public rights of way by small cell equipment. Among the issues considered will be the requirements of section 253 of federal Telecommunications Act\, the FCC's interpretation of section 253 and its application to small-cell deployment\, the impact of section 27 of the New York Transportation Corporations Law\, recent litigation concerning municipal initiatives to regulate (and impose fees on) the use of public rights-of-way\, and recent legislative developments.\n\n\n\nContinuing Education for APA/AICP:\n\nAttendees will receive a certificate documenting their participation in 1.5 hours of training from the Southern Tier Section of the New York Upstate Chapter of the American Planning Association.
